SECTION 2. A NEW SECTION OF KRS CHAPTER 367 IS CREATED TO READ AS FOLLOWS:
As a consumer protection measure for retirees who may retire in a community certified as a Kentucky Certified Retirement Community under Section 1 of this Act, the Office of the Attorney General shall establish and maintain a "Zero Call List". KRS 367.46951(2) and KRS 367.46955(15) notwithstanding, any person over the age of seventy (70) years may apply to the Office of the Attorney General, Division of Consumer Protection, to be listed on the "Zero Call List". The Attorney General shall place the information of the applicant upon this list. The Attorney General shall not remove the information unless requested to do so in writing by the applicant, or upon notice that the given telephone number is no longer held in the name of the applicant. No person shall make a telephone solicitation call of any type to a person who is on the "Zero Call List" unless the call is made pursuant to the prior express invitation or permission of the applicant.
SECTION 3. A NEW SECTION OF KRS CHAPTER 367 IS CREATED TO READ AS FOLLOWS:
(1) Any violation of Section 2 of this Act shall constitute an unfair, false, misleading or deceptive act or practice in the conduct of trade or commerce in violation of KRS 367.170.
(2) All of the remedies, powers, and duties provided for the Attorney General by KRS 367.190 to KRS 367.300 and the penalties provided in KRS 367.990, relating to acts and practices violating KRS 367.170 shall apply with equal force and effect to acts and practices declared unlawful by Section 2 of this Act.
(3) Nothing in Section 2 of this Act shall be construed to limit or restrict the exercise of powers or the performance of the duties of the Attorney General authorized under any other provision of law."; and
